At each of the trials the appellant concerned applied in terms of section 103(3) of the interim Constitution for a postponement of the trial to enable the constitutional issue to be referred to this Court for determination.On each occasion the application was refused and the trial proceeded. The appellants admitted the material allegations made in the charge sheets, indicated that they would challenge the constitutionality of the provisions of the Liquor Act on which the charges were based, and led no evidence.

Massachusetts General Laws Chapter 151B, section 4(1)(A), addresses this issue with respect to employees. who is unable, because of his religious beliefs, to attend classes or to participate in any examination, study or work requirement on a particular day shall be excused from any such examination or study or work requirement, and shall be provided with an opportunity to make up such examination, study or work requirement which he may have missed because of such absence on any particular day; provided, however, that such makeup examination or work shall not create an unreasonable burden upon such school.
